What is Compensation?

An injured person is entitled to claim two distinct types of compensation. Often both are claimed at the same time


1: General Damages
General damages is a sum of money paid to an innocent victim for the pain and suffering caused by an at fault party. These payments take account of such factors as:
  • The type and seriousness of the injury


  • Future pain and disability


  • Deformity


  • Impaired functions e.g. hearing loss, ruined eyesight, loss of sexual function


  • Adverse effect on the victims way of life e.g. inability to play a certain sport or participate fully in family life

2: Special Damages
This is a further payment to the victim for the financial losses he or she has suffered as a result of the accident and the financial losses he or she will suffer in the future. The additional money pays for:

  • Loss of earnings - past and future


  • Damaged or destroyed personal possessions


  • Incidental costs, such as travel expenses


  • Medical care and treatment - past and future


  • Household care in years to come


  • Special equipment e.g. replacement limbs, household appliances or wheelchairs

Is there a time limit for claiming?

For most types of injury compensation there is a time limit of three years to make a claim. However before a claim can be made against a third party we have to gather evidence and put in place the appropriate documentation. In order to do this we normally only work on accidents that have occurred within the last two and a half years. However, if it is between two and a half and three years give us a call and we may still be able to help.

How much compensation could I receive?

No case is the same. There are numerous factors which must be taken into consideration. How long will my case take?

The most important process is establishing that the person you are claiming to be negligent is liable for the injuries you have suffered.
