Right to Buy


If you have been a tenant in a local authority or housing association property for more than five years or moved in prior to 18 January 2005, you may have the right to buy your home, usually at a discounted price. The discount amount will depend on how long you have been a tenant and the policy of the local authority or housing association where you live.

Key differences between Right to Buy Purchase and Residential Property Purchase:

  • You receive your offer to purchase your home from the local authority/housing association, if you wish to proceed then you need to sign the acceptance and provide our details to them and send this back to the relevant authority/association.

  • The Council will then send a surveyor to your property to measure the boundaries of the property (for house purchases not flats) and then the legal department with then draft the Transfer documentation.

  • This process can sometimes take a while depending on which Local Authority/Housing Association you buy from.

  • Instead of the Contract documentation being received as we do in a purchase, we will receive transfer documentation. You must ensure that you keep paying your rent up to and including the day of completion. Completion of your right to buy normally takes place on a Monday and 5 days notice will need to be given to the Council in relation to a completion date.

  • Completion is arranged once we have mortgage offer and everything has been satisfied in relation thereto, the results of your searches and the signed transfer documentation.

We would strongly advise that if you are considering purchasing your home that you obtain the necessary leaflets from the authority/association which contains full details of the restrictions they will place upon you for future sales and re-mortgages of the property. The Right to Buy procedures changed significantly under the Housing Act 2004 and the Council/Association now place further restrictions on the re-sale of your house. Please ensure you read this carefully and aware of the restrictions. If you are in any doubt whatsoever then speak to your conveyancer.
